Agreement to Terms

By accessing or using GenColoring AI, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our service.

1. Our Services

GenColoring AI provides an AI-powered platform that generates custom coloring pages based on your text descriptions. Our service includes free and paid subscription plans with varying features and usage limits.

2. User Accounts

You must create an account to use certain features. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must provide accurate information and update it as needed.

3. Subscriptions and Payment

Payment processing is handled by Creem, our Merchant of Record. By subscribing, you agree to Creem's Terms (https://creem.io/terms) and Privacy Policy (https://creem.io/privacy).

  • We offer free and paid subscription plans with different usage limits
  • Subscription fees are billed in advance on a recurring basis
  • You can cancel your subscription at any time through your account settings
  • Refunds are provided according to our refund policy (see Section 3A below)
  • We reserve the right to modify pricing with advance notice

3A. Refund Policy

You may request a refund within 30 days of your subscription purchase or renewal. Refunds are calculated based on your usage during the billing period.

How to Request

Send an email to contact@gencoloring.ai with your account email and reason for refund. We will process your request within 5-7 business days.

Refunds are not available for violations of our Terms of Service or Acceptable Use Policy.

4. Intellectual Property and Content Ownership

AI-Generated Content Ownership

Ownership of generated coloring pages depends on your subscription tier:

• Free, Basic, and Pro Users: You own the generated images and may use them for personal, educational, and non-commercial purposes.

• Commercial License: Max Users: You own all rights to the generated images with a full commercial license. You may use them for any purpose, including selling, redistributing, or incorporating them into commercial products.

• Free Users: The platform may publicly display your generated content for promotional or showcase purposes.

• Paid Users: Your content will not be publicly displayed without your permission.

Your Prompts and Generation History

All prompts (text descriptions) you submit are stored in your account for the generation history feature.

• Free Users: Your prompts may be made public and visible to other users.

• Paid Users: Your prompts remain private by default. You can choose to make them public if desired.

We do not use your prompts or generated images to train AI models.

Platform Rights

GenColoring AI and its original content, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

5. Acceptable Use and Content Policy

You agree not to:

  • Attempt to circumvent usage limits or security measures
  • Interfere with or disrupt the service or servers
  • Use automated means to access the service without permission
  • Resell or redistribute our service without authorization

⚠️Prohibited Content

You may not use our service to generate content that includes or depicts:

  • Sexually explicit, pornographic, or NSFW (Not Safe For Work) content
  • Violence, gore, or graphic depictions of harm
  • Hate speech, discrimination, or content that promotes violence against individuals or groups
  • Illegal activities or content that violates laws or regulations
  • Content that infringes on intellectual property rights or trademarks
  • Misleading, deceptive, or fraudulent content
  • Content that exploits, harms, or endangers minors in any way

Violations of this content policy may result in immediate account suspension or termination without refund. We use automated and manual review systems to detect prohibited content.

If you encounter inappropriate content generated by other users, please report it to contact@gencoloring.ai.

6. AI-Generated Content

  • Content is generated by AI and may not always meet your expectations
  • We do not guarantee the accuracy, quality, or suitability of generated content
  • You are responsible for reviewing generated content before use
  • Generated content should comply with applicable laws and regulations

7. Disclaimers

The service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not liable for any loss or damage arising from your use of the service.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the past 12 months.

9. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time. Upon termination, your right to use the service will immediately cease.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes by email or through the service. Your continued use after changes constitutes acceptance of the modified terms.

11. Privacy

Your use of the service is also governed by our Privacy Policy. We collect and use your information as described in the Privacy Policy.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the People's Republic of China, without regard to its conflict of law provisions.

Negotiation: In the event of any dispute, the parties agree to first attempt resolution through good-faith negotiation within 30 days.

Arbitration: If negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in Beijing. The arbitration award shall be final and binding.

Language: Arbitration proceedings shall be conducted in English.
